Terms of Service for auraDNA

Welcome to auraDNA. By accessing our website, uploading photos, or purchasing our digital color analysis reports, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
1. The Service
auraDNA is an AI-powered personal color analysis and styling platform. Users can upload photos to receive a free basic color preview or purchase a premium, comprehensive digital styling dossier (the "Report"). Results are generated using artificial intelligence and depend on the quality, lighting, and accuracy of the photos provided.
2. Eligibility
While there is no strict age restriction to use auraDNA, if you are under the age of majority in your jurisdiction (for example, under 18 years old in Ontario), you must have explicit permission from a parent or legal guardian to use the Service, make purchases, and upload photos.
3. Digital Purchases and Access Limitations
Because our product is a highly personalized digital asset that incurs immediate server and AI processing costs, access to your results is governed by the following rules:
- One-Time Purchases (The Premium Dossier): If you purchase a one-time Report, you will have access to view your results via our online portal for exactly seven (7) days from the time the Report is generated. It is your responsibility to download, export, or save your Report within this window.
- Monthly Subscriptions: If you are enrolled in an active auraDNA monthly subscription, you retain continuous access to your portal and generated Reports while your subscription remains active and in good standing. If you cancel or payment fails, access is revoked at the end of your billing cycle.
4. Strict No-Refund Policy
All sales are final. Due to the immediate, non-returnable nature of digital goods and real-time processing costs incurred once your photo is scanned, we do not offer refunds under any circumstances. This includes, but is not limited to:
- Failing to download your report within the access window.
- Dissatisfaction with the seasonal color outcome.
- Results affected by poor photo quality, improper lighting, or not following photo guidelines.
5. User Responsibilities and Photo Quality
The accuracy of your auraDNA scan depends on the photos you provide. You agree to upload photos that follow our guidelines (natural daylight, no makeup, no filters, neutral expression). You acknowledge that uploading photos with artificial lighting, heavy shadows, or digital alterations may result in inaccurate categorization. You warrant that you have the legal right and consent to upload submitted photos.
6. Data Retention and Privacy
Our standard operational practice is to permanently delete uploaded images from active servers 30 days after your Report is generated. By using the Service, you also grant auraDNA the right to retain submitted photos indefinitely at our sole discretion for operational purposes, system maintenance, or improvement of our analysis algorithms.
7. Intellectual Property
All content generated by auraDNA, including our proprietary framework logic, interface designs, educational styling text, and custom palettes, remains the intellectual property of auraDNA. You are granted a personal, non-commercial license to use your generated Report. You may not resell, redistribute, or reverse-engineer our digital products or prompts.
8. Limitation of Liability
auraDNA is an educational styling tool. We do not provide medical, dermatological, or professional psychological advice. To the maximum extent permitted by law, auraDNA is not liable for any indirect, incidental, or consequential damages arising from use of the service, system downtime, or reliance on generated color and style palettes.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of auraDNA shall be resolved exclusively in the courts located in Ontario, Canada.
